On July 10, 2003, the U.S. House of Representatives approved the appropriations bill providing funding to the Department of Labor ("DOL") by a vote of 215-208. This action essentially places the DOL one step closer to implementing its proposed overtime provisions. See KZA Employer Report Vol. 2, Issue 4. The vote was split down party lines, with the Democrats insisting that the DOL's proposed changes would be harmful to employees by exempting them from overtime. An amendment was proposed that would prevent the funding from being used to implement programs that would exempt employees from the overtime provisions of the Fair Labor Standards Act. The Amendment was defeated, and the appropriations bill now goes before the Senate for final approval.
