EEOC Issues Bulletin on How to Handle Applicants and Employees with Epilepsy

On July 28, 2004, the Equal Employment Opportunity Commission ("EEOC") issued a bulletin offering guidance on how to solve workplace issues involving individuals with epilepsy in light of the Americans with Disabilities Act ("ADA"). The bulletin addresses: (1) when epilepsy is considered a "disability" under the ADA; (2) when employers can ask an applicant or employee about his or her epilepsy; (3) what type of reasonable accommodations employees with epilepsy may need; (4) how employers should handle safety concerns related to applicants and employees with epilepsy; and (5) how employers can ensure employees are not harassed because of epilepsy or any other disability.
