U.S. Supreme Court Issues Decision In Public Sector Union Fee Case

In November, we wrote about the case of Friedrichs v. California Teachers Association, where a group of California teachers objected to paying a mandatory service fee to a union they chose not to join. Many legal commentators believed that the U.S. Supreme Court was ready to determine that these fees are unlawful. Following the death of Justice Scalia, however, the Court issued a one-line decision on March 29, 2016, ending the case because the Court is "evenly divided." Accordingly, public sector unions can continue to require "fair share service fees."

The Court's decision simply retains the status quo on this issue and leaves open the possibility of another challenge to these fees in the future.
