EEOC ISSUES BULLETIN ON HOW TO HANDLE APPLICANTS AND EMPLOYEES WITH EPILEPSY

On July 28, 2004, the Equal Employment Opportunity Commission (“EEOC”) issued a bulletin offering guidance on how to solve workplace issues involving individuals with epilepsy in light of the Americans with Disabilities Act (“ADA”).  The bulletin addresses: (1) when epilepsy is considered a “disability” under the ADA; (2) when employers can ask an applicant or employee about his or her epilepsy; (3) what type of reasonable accommodations employees with epilepsy may need; (4) how employers should handle safety concerns related to applicants and employees with epilepsy; and (5) how employers can ensure employees are not harassed because of epilepsy or any other disability.

The bulletin, “Questions and Answers About Epilepsy in the Workplace and the Americans With Disabilities Act (ADA)”, can be viewed at: www.eeoc.gov/facts/epilepsy.html
