As discussed in Volume 8, Issue 1 of KZA’s Employer Report, the new FMLA regulations went into effect on January 16, 2009. These regulations require a variety of changes by those employers who are covered by the FMLA.
One of the changes discussed previously in the Employer Report is the requirement that an employer include in its employee handbook the Department of Labor’s poster (or text of the poster) entitled “Employee Rights and Responsibilities under the Family and Medical Leave Act.” As promised, KZA has revised its prototype FMLA policy to comport with the new regulations. Because the poster provides detailed information about FMLA leave, we have condensed our prototype FMLA policy. We have also prepared a new form, entitled “Instructions for Use of Intermittent Leave under FMLA” which employers can issue to employees taking intermittent leave. The new regulations provide employers with several tools by which to control leave, and these instructions seek to use those tools in the problematic arena of intermittent leave.
