Texas Court Grants Nationwide Injunction Against DOL's New Persuader Rule
As we have discussed in recent posts, KZA joined with other law firms affiliated with Worklaw® Network to file a lawsuit in federal court in Minnesota seeking to stop the U.S. Department of Labor (DOL) from enforcing its new "persuader rule ". In addition to the Minnesota lawsuit, t here are two other lawsuits presently challenging the lawfulness of the persuader rule.

EEOC Plans To Issue New Guidance On Retaliation
The EEOC has announced that it plans to issue revised and updated guidance on retaliation claims to replace its 1998 Compliance Manual on Retaliation. The EEOC explains that retaliation charges have "roughly doubled" since 1998, "making retaliation the most frequently alleged type of violation raised with EEOC." Because "ensuring that employees are free to come forward to report violations of our employment discrimination laws is the cornerstone for effective enforcement," the EEOC has updated and revised its prior guidance to address new court decisions and to help employers prevent retaliation and employees better understand their rights.

KZA Partner Carol Davis Zucker Publishes Article On a Developing Tort Theory Used By Employees Against Employers

As part of the inaugural issue of the Nevada Practitioners' Journal of Labor and Employment Law, KZA partner Carol Davis Zucker discusses employees' use of a novel tort claim against their current and former employers for the alleged breach of a special relationship. In her article, entitled An Enigma Inside a Puzzle: Confidential and Special Relationships and Their Limited Application in the Employment Context, Carol analyzes the basis for such claims and the rare circumstances where courts have found a special relationship to exist with regard to a worker's employment, thereby providing employees with an additional, independent cause of action.
The Nevada Practitioners' Journal of Labor and Employment Law is a publication of the Labor and Employment Law Section of the State Bar of Nevada. Carol, as well as KZA partner Edwin Keller, is a prior Chairperson of the Labor and Employment Law Section.
